Sofa to 5K Challenge Official Contest Rules

NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. Eligibility
    You must have Internet access, a Facebook account and a valid email address to participate. The Sofa to 5K Challenge (The Challenge) is open only to adult legal residents of the lower forty-eight (48) states of the United States (including District of Columbia) (excludes Alaska & Hawaii) and Canada who are eighteen (18) years of age or older at the time of entry. Void in Guam, Puerto Rico, and anywhere else prohibited by U.S. law. The Contest is subject to all applicable federal, state and local laws and regulations. Participation in the Contest constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to The Challenge. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Challenge consists of a 10-week Sofa-to-5K training plan, completion of a local 5K, submission of photo and story and voting on a Facebook application.

  3. Timing
    The Sofa to 5K Challenge begins on September 15, 2014 at 12:00 a.m. Central Standard Time (“CST”) and ends on November 30, 2014 at 11:59 p.m. CST (The Contest Period). Sponsor’s computer is the official time keeping device for this Contest. All entries must be received by Sponsor no later than December 5, 2014 at 11:59 p.m. CST. Any entries received after this date and time will not be eligible.

  4. How to Enter
    Prior to the start of The Challenge, sign up to participate at http://sofato5kchallenge.horizonfitness.com by filling out the entry form with your name, email, address, phone number, birth date and shirt size. Complete the 10-week Sofa to 5K Challenge training plan and run a 5K in your community and have someone take a photo of you as you or after you finish the race. Go to https://www.facebook.com/HorizonFitness and Like the official Horizon Fitness Facebook page. Find the “2014 Sofa to 5K Challenge – Horizon Fitness” group and submit your race photo with a story (500 words or less) illustrating how the Sofa to 5K Challenge has changed your life / view on how to incorporate running more into your life. Consider including the actions you took throughout the Challenge and the results you achieved i.e. completed first ever 5K in “x” time, number of pounds lost, loss of body fat percentage, increase in energy. Post your entry by clicking the “Submit” button. Proof of entering information at the Website is not considered proof of delivery or receipt by Sponsor of such entry.

    Limit one entry per person, per email address, per Website during the Contest Period. Multiple participants are not permitted to submit entries using the same email address. Any attempt by any participant to submit more than one entry by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Sponsor and will not be returned. Sponsor reserves the right to contact entrants and all other individuals whose email address is submitted as part of this Contest.

  5. Winner Selection
    Public voting will open on December 8, 2014 at 8 a.m. CST, and will end on Sunday, December 14, 2014 at 11:59 p.m. CST. The Grand Prize Winner will be chosen by Facebook vote.

    Sponsor’s decisions as to the administration and operation of the Challenge and the selection of potential winners are final and binding in all matters related to the Challenge. Winners will be notified by email, phone and/or mail on or about December 16, 2014. In the event of a tie, the entry from among all such tied entries with the highest score in “Emotional impact of submission and ability to inspire others” will be deemed the winning entry by the Sponsor. Odds of winning shall depend on the number of eligible entries received by Sponsor.

    FOR ALL PHOTOS/CAPTIONS POSTED ON THE CONTEST WEB SITE, THE PHOTOS/CAPTIONS REPRESENT SOLELY THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR IN ANY MANNER. SPONSOR IS ACTING AS A PASSIVE CONDUIT FOR THE POSTING/PUBLICATION OF PHOTOS/CAPTIONS AND HAS NO OBLIGATION AND EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY IN CONJUNCTION WITH SCREENING, MONITORING, OR REVIEWING THE CONTENT OF PHOTOS/CAPTIONS. SPONSOR WILL NOT EDIT PHOTOS/CAPTIONS PRIOR TO POSTING THEM ON THE CONTEST WEB SITE FOR PURPOSES OF THE CONTEST.

    Regarding Public Voting: There is a limit of one (1) vote/like per person during the Contest Period. Only one (1) person may use a given e-mail address or Facebook account to submit vote(s)/like(s). Votes must be manually key-stroked. Use of automated or programmed voting methods is prohibited and any votes obtained by such means will be voided. Use of any device or artifice to manipulate or compromise the integrity of the voting procedure will result in voiding of votes deemed by Sponsor in its sole discretion to have been affected by such actions and/or disqualification of contestants whose entries benefitted from such actions and/or other legal sanctions. Such illicit actions include, by way of example only, offering of gifts/benefits/consideration in exchange for voting or not voting for a given entry or disparaging a given contestant’s entry.

  6. POTENTIAL CHALLENGE WINNER IS SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.

  7. Verification of Potential Winner
    Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner of a prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner after further evaluation of all remaining eligible entries. Sponsor may require prize winner to execute and deliver an Affidavit of Eligibility stating that winner meets all eligibility requirements of The Challenge, and a release of liability.

  8. Grand Prize
    ONE (1) GRAND PRIZE: The Grand Prize Winner will receive a Horizon Fitness exercise equipment product of their choice, including a treadmill, elliptical or exercise bike, valued at $1199. Sponsor shall provide to Grand Prize Winner a copy of Sponsor’s published warranty for the product then in effect at the time the prize is awarded. Such warranty shall be exclusive and in lieu of all other representations and warranties with respect to the product, express or implied. Sponsor expressly disclaims and excludes any implied warranty of merchantability or fitness for a particular purpose. Prize is non-transferable. No substitution, assignment or transfer of prize permitted, except by Sponsor, which reserves the right in its sole discretion to substitute a prize with another prize of greater or equal value. Approximate retail value of the grand prize is dependent on the prize awarded. Payment of taxes on any prize awarded with respect to The Challenge are the sole responsibility of the winner of such prize. Grand Prize must be claimed by winner no later than March 31, 2015.

  9. Entry Conditions and Release
    By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Challenge; (b) release and hold harmless the Sponsor and its parent, subsidiary, associated, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Challenge, and all of their respective past, present and future shareholders, officers, directors, employees, agents, representatives and attorneys (collectively, the “Released Parties”) from and against: (i) any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any Challenge entries (including videos submitted), and prize/s, except for liability which cannot be excluded by law, and (ii) any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry, creation of an entry or submission of an entry, participation in the Challenge, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Challenge and/or entrant’s acceptance, use or misuse of prize.

  10. Publicity
    Once submitted, entries become the sole property of Sponsor and cannot be modified by entrant. By submitting an entry, entrant gives permission to Sponsor and hereby grants Sponsor a royalty-free, irrevocable, perpetual, worldwide, sublicensable, nonexclusive license to post contestant's entry (in whole or in part), name (first name, last initial), and all other information about the contestant contained in the entry on the World Wide Web, and to otherwise use contestant's name, likeness and all other information about the contestant in the entry without compensation in accordance with the requirements of this Challenge and the advertising, promotion, and publicity of the Challenge, and otherwise, as stated in these Official Rules (as solely determined by Sponsor). Except where otherwise prohibited, participation in the Challenge constitutes winners consent to Sponsor's and its agents' use of winner's name, likeness, photograph, voice, story, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. Such grant of rights will be confirmed by winner upon Sponsor’s request and winner agrees to sign any and all necessary confirming documents without compensation of any kind (other than the prize).

  11. General Conditions
    Sponsor reserves the right to cancel, suspend and/or modify the Challenge, or any part of it, if any fraud, technical failures or problems, computer viruses or bugs, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Challenge, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

  12. Limitations of Liability
    The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to, lost, late, corrupted, misdirected or incomplete entries, electronic or computer malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury, loss, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize. If the Contest, or any part of it, is discontinued for any reason, Sponsor may, at its discretion, elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the prize offered herein. No more than the stated number of prizes will be awarded.

  13. Disputes
    Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Challenge, or any prizes awarded, other than those concerning the administration of the Challenge or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Challenge, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Wisconsin State Court located in Dane County, Wisconsin; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Challenge, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of the State of Wisconsin or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wisconsin.

  14. Entrant's Personal Information
    Information collected from entrants is subject to the Sponsor's Privacy Policy which is available at http://www.horizonfitness.com/PrivacyPolicy

  15. Contest Results
    For a copy of these Official Rules and/or the Contest results including a winner list, send a hand-printed, self-addressed, stamped envelope to Winners List - - Horizon Fitness; Sofa to 5K Challenge, c/o Johnson Health Tech North America, Inc., 1600 Landmark Dr, Cottage Grove, WI 53527. Requests for the winner list must be received by March 31, 2015.
